Malta has introduced further amendments to its beneficial ownership framework. The latest update to beneficial ownership Malta rules comes through the Companies Act (Register of Beneficial Owners) (Amendment) Regulations, 2026 (Legal Notice 184 of 2026), which came into force on 10 July 2026.
The changes continue Malta’s efforts to strengthen transparency, enhance anti-money laundering safeguards and align its regulatory framework with evolving European standards.
A more Structured Access Regime
Perhaps the most significant development is the introduction of a tiered access system for the Register of Beneficial Owners.
Rather than applying a single standard to all applicants, the Regulations now distinguish between different categories of users depending on the purpose for which access is requested. This approach seeks to strike an appropriate balance between corporate transparency and the protection of personal data.
One of the new access categories introduces a harmonised concept of “legitimate interest,” whereby certain persons and organisations are presumed to satisfy the legal threshold required to access beneficial ownership information, provided their request is connected to the prevention or detection of money laundering, terrorist financing or related criminal activity.
